Action on the case, to recover damages from the defendant for interference with plaintiff's employment contract allegedly
resulting in the plaintiff's dismissal. Trial by jury resulted in a verdict for the plaintiff. Defendant's exceptions to the
denial of his motion for a nonsuit and to the admission of certain evidence were reserved and transferred by Grimes, J. The plaintiff had been employed for several years as a repair man in the tire department of Sears, Roebuck & Company
in which the defendant was the division manager. The plaintiff's evidence showed that he was considered efficient and that
he had received an award for meritorious service shortly before his dismissal. There was evidence supporting the plaintiff's
claim that the defendant consistently complained of the quality and quantity of the plaintiff's work, that the defendant ridiculed
him in the presence of customers, threatened "to get rid of" him and generally made conditions difficult for the plaintiff
by making various charges and complaints about the plaintiff to the general manager and other employees. The plaintiff was
dismissed by the general manager because he "had been rude to a customer." The general manager also gave another reason for
the dismissal but what that reason was does not appear in the record.
